Legal Malpractice

Legal Malpractice is the area of law surrounding negligence on the part of an attorney that causes harm to his or her client. The Client has to show that but for the negligence of the attorney, they would not have been harmed in this way.  By suing a lawyer that has been negligent a client may be able to gain back what was lost by this attorney’s negligence.

The client usually must be able to demonstrate that the loss of their case was due to the legal malpractice claimed.  One of the more common ways legal malpractices occurs in when an attorney breaches a fiduciary duty.  Some of the fiduciary duties owed to clients by their attorney’s are the duty of care, duty of loyalty, duty of confidentiality, and the duty of disclosure.  Although an attorney may make mistakes, in order to prevail on a legal malpractice claim, the client must demonstrate that the attorney breached the standard of care.
